Does a transferring conveyancer act in the interests of the person who appointed them?

No.

A transferring conveyancer does not act for the buyer or the seller. Their role is to carry out the terms of the sale agreement and ensure that both parties' rights and obligations are properly fulfilled. They act objectively and in accordance with the agreement, not in the interests of the person who appointed them.

This leads to another question:

If the transferring conveyancer does not act in the interests of the person who appoints them, why should the appointment be made by only one party?

Traditionally, the appointment of the transferring conveyancer has been reserved for the seller. Over time, this has become an accepted industry practice. As a result, buyers are often required to pay the transfer fees of a conveyancer they had no role in selecting.
